Client Obligations and Responsibilities

1. Accurate Information

You agree to provide accurate, complete, and truthful information when:

  • Submitting service requests or inquiries
  • Describing your property conditions and service needs
  • Providing contact and billing information
  • Communicating special requirements, hazards, or access instructions

Providing false or misleading information may result in service delays, additional charges, or refusal of service.

2. Property Access and Safety

You are responsible for ensuring that:

  • Our team has safe and unobstructed access to areas requiring cleaning
  • You have disclosed all potential hazards, including aggressive pets, hazardous materials, or structural issues
  • All necessary utilities (water, electricity) are available and functional
  • Valuables and fragile items are secured or identified before service begins
  • You have the legal authority to grant access to the property

Failure to provide safe working conditions may result in service suspension or additional charges.

3. Compliance with Laws

You agree to comply with all applicable local, state, and federal laws and regulations when engaging our services. This includes but is not limited to laws regarding property access, employment, health and safety, and consumer protection.

4. Conduct Requirements

You agree to treat our team members with respect and professionalism. Unacceptable conduct includes:

  • Harassment, discrimination, or abusive behavior of any kind
  • Inappropriate or unwelcome advances toward team members
  • Threats, intimidation, or violent behavior
  • Interference with service delivery

We reserve the right to immediately terminate services and remove our team from your property if such behavior occurs, without refund.

5. Payment Obligations

You agree to pay all fees and charges associated with services provided according to the agreed-upon payment terms. This includes any additional charges for services beyond the original scope, late cancellation fees, or costs arising from inaccurate information provided.

6. Indemnification

You agree to indemnify and hold harmless Serene Shine, its employees, and contractors from any claims, damages, losses, or expenses arising from your breach of these terms, your violation of any law, or your willful misconduct or negligence.

Warranties, Disclaimers, and Limitations

Service Warranty

We strive to provide high-quality cleaning services and stand behind our work. However:

  • We cannot guarantee specific results due to variations in property conditions, materials, and pre-existing issues
  • Some stains, odors, or damage may be permanent or beyond the scope of standard cleaning
  • Results may vary based on factors outside our control

If you are unsatisfied with our work, please contact us within 48 hours of service completion so we can address your concerns.

Disclaimer of Warranties

To the fullest extent permitted by law, our services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties regarding website accuracy, reliability, or availability
  • Warranties that our services will meet all your expectations
  • Warranties that services will be uninterrupted or error-free

Limitation of Liability

To the maximum extent permitted by law, Serene Shine shall not be liable for:

Consequential Damages

Any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, goodwill, or other intangible losses.

Pre-existing Conditions

Damage resulting from pre-existing conditions, hidden defects, or issues not apparent during initial assessment.

Third-Party Actions

Actions or negligence of third parties, including property managers, landlords, or other service providers.

Acts Beyond Our Control

Circumstances beyond our reasonable control, including natural disasters, extreme weather, power failures, or other force majeure events.

Our total liability for any claim arising from our services shall not exceed the amount you paid for the specific service giving rise to the claim.

Property Damage and Insurance

While we take great care in providing our services:

  • We are not responsible for damage to items that were not disclosed as fragile or valuable
  • We recommend securing or removing extremely valuable or irreplaceable items before service
  • Claims for damage must be reported within 24 hours of service completion
  • We carry general liability insurance, but coverage is subject to policy terms and conditions

Exclusion of Certain Damages

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such cases, our liability will be limited to the greatest extent permitted by applicable law.

Legal Provisions and Dispute Resolution

Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law principles.

Any legal action or proceeding arising from these terms shall be brought exclusively in the courts of New South Wales, and you consent to the jurisdiction of such courts.

Dispute Resolution Process

In the event of any dispute, controversy, or claim arising from these terms or our services, the parties agree to follow this resolution process:

  1. Direct Communication: Contact us directly to discuss the issue. Many concerns can be resolved through open dialogue.
  2. Negotiation: Both parties will make good faith efforts to negotiate a mutually acceptable resolution within 30 days.
  3. Mediation: If negotiation fails, the parties may agree to non-binding mediation with a mutually acceptable mediator.
  4. Legal Action: Only after exhausting the above steps may either party pursue formal legal action in the appropriate jurisdiction.

Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If such modification is not possible, the invalid provision shall be severed, and the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Serene Shine regarding your use of our services and supersede all prior or contemporaneous understandings and agreements, whether written or oral.

Waiver

Our failure to enforce any right or provision of these terms shall not constitute a waiver of such right or provision. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

Assignment

You may not assign or transfer these Terms and Conditions or any rights or obligations hereunder without our prior written consent. We may assign these terms without restriction. Any attempted assignment in violation of this provision shall be void.

Force Majeure

Neither party shall be liable for any failure or delay in performance due to circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

Modifications to Terms

We reserve the right to modify or update these Terms and Conditions at any time to reflect:

  • Changes in our business practices or service offerings
  • New legal or regulatory requirements
  • Improvements to our services or policies
  • Clarifications based on customer feedback or legal advice

When we make material changes to these terms:

  • We will update the "Last Revised" date at the top of this document
  • We may notify existing clients through email or prominent website notice
  • Continued use of our services after changes constitutes acceptance of the modified terms
